Welcome to LiKQ Store, operated by LiKQ Music ("we", "us", or "our"). These Terms & Conditions ("Terms") govern your access to and use of the LiKQ Store merchandise platform at likqmusic.com/merch, including browsing, purchasing, and any related services.

By accessing or using LiKQ Store, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Definitions

  • "Store" — The LiKQ Store merchandise platform at likqmusic.com/merch
  • "Products" — All items available for purchase, including Physical Products, Digital Products, Concert Tickets, and Services
  • "Physical Products" — Tangible merchandise and goods that are shipped to your address
  • "Digital Products" — Digital content (e.g., digital music, digital artwork, downloadable files) delivered electronically via email
  • "Concert Tickets" — Event admission tickets delivered as e-tickets via email or as physical tickets via carrier
  • "Services" — Custom or commissioned work (e.g., custom projects, creative commissions) agreed upon between LiKQ and the customer, fulfilled through direct communication
  • "Scope Agreement" — Written documentation of the agreed service scope, deliverables, and timeline, confirmed before payment is collected
  • "Deposit" — A 50% upfront payment required to initiate a Service under the Deposit payment option
  • "Account" — Your registered user account on the Store
  • "Order" — A confirmed purchase of one or more Products
  • "Content" — All text, images, product descriptions, and media displayed on the Store

2. Account Registration

2.1 Eligibility

You must be at least 13 years of age (or the age of majority in your jurisdiction) to create an account and use the Store. If you are under the age of majority, you must have consent from a parent or legal guardian.

2.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate and complete information when creating your account.
  • You must notify us immediately of any unauthorized use of your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if:

  • You violate these Terms
  • You engage in fraudulent or abusive behavior
  • Your account has been inactive for an extended period

3. Products & Pricing

3.1 Product Types

We offer the following types of products:

3.2 Product Information

We strive to display accurate product descriptions, images, and pricing. However:

  • Product colors may vary slightly due to screen display differences (Physical Products).
  • We reserve the right to correct errors in product descriptions or pricing at any time.
  • Products are subject to availability and may be discontinued without notice.

3.3 Pricing

  • All prices are displayed in Thai Baht (฿) and include applicable taxes unless stated otherwise.
  • Prices are subject to change without prior notice. However, price changes will not affect orders that have already been confirmed.
  • Shipping fees for Physical Products, if applicable, are calculated and displayed at checkout before you confirm your order. Digital Products have no shipping fees.
  • For Services, pricing is agreed upon during the initial contact. A Deposit (50%) or full payment (100%) is required before work begins.

3.4 Product Variants

Products may be available in multiple variants (size, color, format, etc.). Each variant may have different pricing and stock availability.

4. Orders & Purchases

4.1 Placing an Order

  • Adding items to your cart does not reserve them. Products remain available to other customers until your order is confirmed and paid.
  • An order is confirmed only when we send you an order confirmation email.
  • We reserve the right to refuse or cancel any order for any reason, including but not limited to: product unavailability, pricing errors, suspected fraud, or payment failure.
  • For Services, an order is not fully confirmed until the Scope Agreement is established and the agreed payment (Deposit or full) is received.

4.2 Order Confirmation

Upon successful payment, you will receive an order confirmation email containing:

  • Order number
  • Itemized list of products purchased
  • For Physical Products: shipping address and estimated delivery timeline
  • For Digital Products: download link(s) or access instructions
  • For Services: confirmation of initial contact timeline (our team will reach out within 2 business days)
  • Payment summary

4.3 Order Cancellation

  • Physical Products: You may request cancellation before the order has been shipped by contacting us at [email protected]. Once shipped, cancellation is no longer possible — please refer to our Refund & Return Policy instead.
  • Digital Products: Due to the nature of digital goods, all orders for Digital Products are final and cannot be cancelled once the download link has been delivered. No exceptions apply based on whether the link has been accessed.
  • Services: Cancellation conditions depend on the payment option chosen and the stage of work. See Section 7.3 and Section 7.4 for full details.
  • We reserve the right to cancel orders due to stock issues, pricing errors, or suspected fraud. In such cases, you will receive a full refund.

4.4 Mixed Orders

Orders containing multiple product types will be processed as follows:

  • Digital Products will be delivered via email immediately upon payment confirmation.
  • Physical Products will be shipped separately according to standard shipping timelines.
  • Services: our team will contact you within 2 business days to establish the Scope Agreement.
  • Cancellation rules apply separately to each product type within the order.

4.5 Digital Product Delivery

  • Digital Products are delivered to the email address associated with your account.
  • Download links are valid for 30 days from the date of delivery.
  • Each download link allows a maximum of 5 downloads.
  • If your download link expires or you encounter issues, you may request re-delivery within 7 days by contacting us at [email protected].
  • It is your responsibility to ensure that the email address on your account is correct and that you can receive emails from us.

5. Payment

5.1 Payment Methods

We accept payments through Omise (Opn Payments), which supports the following methods:

5.2 Payment Processing

  • All payments are processed securely through Omise. We do not store your full card details on our servers.
  • Payment must be completed at the time of order placement.
  • Your order will not be processed until payment is successfully received.
  • For PromptPay payments, the QR code is valid for a limited time. If the payment is not completed within the time limit, the order will be cancelled and you may place a new order.

5.3 Payment Security

  • Omise is PCI DSS Level 1 certified, ensuring the highest level of payment data security.
  • All transactions are encrypted using industry-standard SSL/TLS protocols.

5.4 Failed Payments

If your payment fails:

  • Your order will not be confirmed.
  • No charge will be made to your payment method.
  • You may attempt to place the order again with a different payment method.

5.5 Service Payment Structure

For Services, two payment options are available:

  • No work begins until the agreed payment is received and confirmed.
  • The payment option is documented in the Scope Agreement.

6. Shipping & Delivery (Physical Products & Concert Tickets)

6.1 Shipping Areas

  • We currently ship within Thailand only.
  • International shipping may be offered in the future and will be subject to additional terms.

6.2 Shipping Fees

  • Shipping fees are calculated based on order weight, dimensions, and delivery address.
  • Free shipping may be offered for orders exceeding a specified minimum amount, as displayed on the Store.

6.3 Delivery Timeline

  • Estimated delivery times are provided at checkout and in your order confirmation email.
  • Delivery times are estimates only and are not guaranteed. Delays may occur due to carrier issues, weather, holidays, or other factors beyond our control.
  • We are not liable for delays caused by shipping carriers or force majeure events.

6.4 Delivery Confirmation

  • You will receive a shipping notification email with a tracking number once your order is dispatched.
  • Delivery is considered complete when the carrier marks the package as delivered.

6.5 Undeliverable Packages

If a package cannot be delivered due to an incorrect address provided by you, or if the package is returned to us:

  • You will be responsible for any additional shipping costs to redeliver the package.
  • We will contact you to arrange redelivery or a refund (minus shipping costs).

7. Services

7.1 Service Agreement Process

  1. Upon purchase, our team will contact you within 2 business days via email or phone.
  2. We will agree on the scope, deliverables, timeline, and payment option, all documented in writing as the Scope Agreement.
  3. No work begins until the Scope Agreement is confirmed and the agreed payment is received.
  4. If you have not been contacted within 2 business days, please email [email protected].

7.2 Scope & Revisions

  • A written amendment agreed by both parties
  • Additional charges (if applicable)
  • Revised timeline confirmation
  • The Scope Agreement is binding. Work will not begin without it.
  • Minor revisions within the original scope are included, up to 2 rounds.
  • Revised timeline confirmation
  • Work on out-of-scope changes will not begin until the written amendment is agreed upon.

7.3 Cancellation & Breach — Deposit Option (50% upfront)

7.4 Cancellation & Breach — Full Payment Option (100% upfront)

7.5 Delivery & Acceptance

  • Completed work is delivered to the customer for review.
  • The customer has 3 business days from the delivery date to review and raise written objections.
  • If no objections are raised within the review period, the work is deemed accepted.
  • For the Deposit option: final payment (50%) is due immediately upon acceptance.
  • Valid objections must clearly identify where the work does not meet the agreed Scope Agreement. Dissatisfaction based on personal preference that falls within the agreed scope does not constitute a valid objection.

7.6 Customer Cooperation

  • Pause the project until materials are received, or
  • Terminate the project, applying the applicable cancellation conditions in Section 7.3 or 7.4
  • The customer is responsible for providing all required materials, content, references, and approvals on time as agreed in the Scope Agreement.
  • Delays caused by the customer's failure to cooperate will extend the timeline accordingly and do not constitute a breach by LiKQ.
  • Terminate the project, applying the applicable cancellation conditions in Section 7.3 or 7.4

7.7 Service Disclaimer

  • Services are custom in nature. Final output reflects the agreed Scope Agreement, not subjective expectations outside of it.
  • LiKQ is not liable for outcomes that fall outside the documented Scope Agreement.

8. Saved Addresses

  • You may save one or more shipping addresses to your account for convenience.
  • You are responsible for ensuring that saved addresses are accurate and up to date.
  • We are not liable for failed or misdirected deliveries due to incorrect saved addresses.
  • You can manage (view, edit, delete) your saved addresses at any time from your account settings.

9. Intellectual Property

9.1 Ownership

All content on the Store — including but not limited to logos, brand names, product images, descriptions, designs, and website layout — is the property of LiKQ Music or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 Digital Product License

When you purchase a Digital Product, you are granted a limited, non-exclusive, non-transferable, revocable license to use the content for personal, non-commercial purposes only. Specifically:

  • You may download and store the Digital Product on your personal devices.
  • You may not redistribute, resell, sublicense, publicly display, or share the Digital Product with third parties.
  • You may not modify, reverse engineer, or create derivative works based on the Digital Product without our prior written consent.
  • This license does not transfer ownership of the intellectual property in the Digital Product.
  • We reserve the right to revoke this license if you violate these Terms.

9.3 Service Output Ownership

Ownership of the final deliverable from a Service is determined solely by mutual agreement and must be explicitly documented in the Scope Agreement before work begins. There is no automatic transfer of ownership to either party.

  • If ownership terms are not specified in the Scope Agreement, all intellectual property rights in the final deliverable remain with LiKQ until a separate written agreement is made.
  • If ownership is agreed to transfer to the customer, such transfer takes effect only upon receipt of full payment.
  • LiKQ retains the right to display the work in portfolios or promotional materials unless the customer requests confidentiality in writing within the Scope Agreement.
  • Any pre-existing intellectual property belonging to LiKQ used in the delivery of a Service remains the property of LiKQ regardless of the agreed ownership terms.

9.4 Store Content License

You are granted a limited, non-exclusive, non-transferable license to access and use the Store for personal, non-commercial purposes only.

9.5 Restrictions

You may not:

  • Copy, reproduce, or distribute any content from the Store without our written consent.
  • Use our trademarks, logos, or brand name without authorization.
  • Scrape, crawl, or use automated tools to extract data from the Store.
  • Modify, reverse engineer, or create derivative works based on the Store or its content.

10. User Conduct

When using the Store, you agree not to:

  • Use the Store for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the Store, other accounts, or computer systems.
  • Interfere with or disrupt the Store's functionality or servers.
  • Submit false or misleading information, including fraudulent orders or fake account details.
  • Engage in any activity that could harm, disable, or impair the Store.
  • Share, redistribute, or publicly post Digital Products purchased from the Store.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Store and all Products (physical, digital, and services) are provided "as is" and "as available" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Store or purchase of Products.
  • For Digital Products, we are not liable for any loss or damage resulting from your inability to download or access Digital Products due to your email, internet connection, or device issues.
  • For Services, our liability is limited to the refund conditions specified in Section 7.3 and 7.4. We are not liable for indirect losses arising from delays or failure to deliver a Service.
  • Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid for the specific Product(s) giving rise to the claim.

12. Disclaimers

  • We do not guarantee that the Store will be available at all times or free from errors, interruptions, or security vulnerabilities.
  • We are not responsible for any damage to your device or data resulting from your use of the Store or from downloading Digital Products.
  • Product images are for illustration purposes. Actual Physical Products may differ slightly in appearance.
  • Digital Products are provided as-is. We do not guarantee compatibility with all devices or software.
  • Service outcomes are defined by the Scope Agreement. We do not guarantee outcomes beyond the documented scope.

13. Governing Law & Disputes

  • These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
  • Any dispute arising from or relating to these Terms or your use of the Store shall be subject to the exclusive jurisdiction of the courts of Thailand.
  • Before initiating legal proceedings, we encourage you to contact us to resolve disputes amicably.

14. Changes to These Terms

  • We reserve the right to modify these Terms at any time.
  • Updated Terms will be posted on this page with a revised "Last Updated" date.
  • For material changes, we may notify you via email or a prominent notice on the Store.
  • Continued use of the Store after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
